Frage von rentner: Darf ein Makler seine ihm übertragenen zu verkaufenden Häuser selbst kaufen?
Fall: Unser Vermieter beauftragte die Sparkasse (deren Immobilienmakler) das Haus zu verkaufen. Zunächst bemühte sich der Makler um den Verkauf. Es gab aber kein Resultat. Nachdem ich auch mein Interesse gegenüber unserem Vermieter mitgeteilt hatte, rief er nach einigen Monaten an. Ich könne das Haus kaufen. Der Preis erschien mir aber immer noch etwas zu hoch. Die Sparkasse hatte inzwischen ebenfalls den Angebotspreis stark gesenkt. Nun ging es schnell. Mein Vermieter meldete sich telefonisch und forderte das Haus zu seinem Preis zu kaufen oder der Makler der Sparkasse kauft es selbst. Dieses Angebot lag etwas über meinem. Darf der Makler überhaupt als Käufer auftreten???????

Aber klar doch. Welches deutsche Recht sollte dies verbieten. Angebot und Nachfrage entscheiden auch hier über den Preis. Der war dir zu hoch und somit hat ein anderer den Zuschlag bekommen. Das dies der Angestellte der Sparkasse aus der Immobilienabteilung ist, spielt hier keine Rolle.

Es ist weder rechtlich, moralisch oder sonst wie verwerflich.
